IBC Section 401 — Buildings, Structures and Premises

Updated Apr 3, 2026
Establishes setback requirements for buildings from property lines and public ways.

Section 401 requires that buildings are set back from property lines in accordance with local zoning and planning regulations. Typical setback distances vary from zero for commercial buildings to 25-50 feet for residential. Encroachments into public right-of-way are not permitted except for approved elements like stairs, balconies, and porches meeting specific conditions. Porches and stoops may project into required setback areas. Balconies on upper floors may overhang public sidewalks if they clear pedestrian paths by at least 7 feet 6 inches. Underground structures may extend under public right-of-way with approval. Awnings may extend over sidewalks within specific projection limits.
